Noble Khan’s Terms & Conditions apply to all of Noble Khan’s products and services including the website www.noblekhan.com booklets, course materials, consultancy services, the online Asian Religion and Culture Training course; all workshops including the face to face Asian Culture Training course; The British Culture course; the Islam & People Culture course; the Diversity and Discrimination course; inspirational talks, coaching and presentations and consultancy work and all other such products and services that Noble Khan may provide.

Changes to Terms and Conditions

These website terms and conditions may be changed by us at any time. You will be deemed to accept the terms and conditions (as amended) when you next use this site following any amendment. If any provision of these terms and conditions is held to be invalid by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining provisions, which shall remain in full force and effect.

Copyright

The rights in material on this site and all Noble Khan Ltd literature are protected by international copyright, software and trademark laws and you agree to use this site and hard copy literature in a way which does not infringe these rights. Noble Khan Ltd does not permit any copying of material from ‘noblekhan.com’ or branded literature.
 

Data Protection

Noble Khan use EDI to formally accredit your test results. Only the delegates’ name and date of birth and sex are provided to EDI. We will process any data which you provide in completing the online registration or application forms and any further forms, assessments or personal details which you complete or provide to us when using this site in accordance with UK Data Protection legislation.

Individual bookings
For those who have booked as individuals who require any form of assistance or support please ensure that you contact the office to discuss any form of support that you may require at the time of booking. Please also state whatever your requirements are as clearly as possible on the booking form. Please note that we may need two to three months to organise some types of additional support and so as much notice as possible is required. If using the online booking form please let us know about how we can make our course accessible for you. Failure to notify Noble Khan of any requirements in ample time prior to the course will result in Noble Khan being unable to permit attendance on the day. Regrettably Noble Khan may not be able to satisfy all requests and relevant factors will include resources available to Noble Khan on a case by case basis. However every request will be considered very carefully and if at all possible will be made possible.

Organisation bookings
For those who book as an organisation please note that it is your responsibility to inform Noble Khan of any additional support that your employee delegates may require as soon as the booking is made. However please note that it is the duty of the employer organisation to ensure that all additional types of support for example learning aids are provided for your employee delegates. Failure to notify Noble Khan of any requirements in ample time prior to the course and ensuring that the additional support is available on the day will result in Noble Khan being unable to permit attendance on the day of the delegates who will be adversely affected by the lack of support required.

Your use of this website is subject to the following terms and conditions, which you are deemed to accept each time you use the website. "You" means the person firm, company or organisation browsing and/or using the Noble Khan website, and "your" shall be construed accordingly.

Interruptions and Omissions in Service

Whilst Noble Khan Ltd will try to ensure that the standard of this website remains high and to maintain the continuity of it, the internet is not an inherently stable medium, and errors, omissions, interruptions of service and delays may occur at any time. Noble Khan Ltd does not accept any liability arising from any such errors, omissions, interruptions or delays or technical issues arising out of your hardware or your connection to the internet. We may vary the specification of this site from time to time without notice.

Liability generally

Noble Khan Ltd accept no liability for any loss (whether direct or indirect, for loss of business, revenue or profits, wasted expenditure, corruption or destruction of data or for any other indirect or consequential loss whatsoever) arising from your use of the site and we hereby exclude any such liability, whether in contract, tort (including for negligence) or otherwise. We hereby exclude all representations, warranties and conditions relating to this website and your use of it to the maximum extent permitted by law.

You agree to indemnify us and keep us indemnified against all costs, expenses, claims, losses, liabilities or proceedings arising from use or misuse by you of this site.

You must notify us immediately if anyone makes or threatens to make any claim against you relating to your use of this site.

In order to register with this site’s online courses, you will need to use a user name and password. You are solely responsible for the security and proper use of your password, which should be kept confidential at all times and not disclosed to any other person. You must notify us immediately if you believe that your password is known to someone else or if it may be used in an unauthorised way. We accept no liability for any unauthorised or improper use or disclosure of any password.

Termination of your access to www.noblekhan.com

Noble Khan Ltd may terminate your registration and/or deny you access to the site or any part of it (including any services, goods or information available on or through the site) at any time in our absolute discretion and without any explanation or notification.

Payment Terms and Conditions for Online Credits

The Online course can only be accessed by the purchase of Online credits via the website www.noblekhan.com or telephoning booking that will be confirmed by the production of an invoice.

Noble Khan will not allocate any credits until the relevant fee is paid in full.

Noble Khan Ltd shall not be under any liability to the client until such time as full payment has been received by Noble Khan.

No Online credits will be added to your account until all relevant invoices are paid in full.

On line credits must be used within 12 months of you first accessing the on line course. Access will be automatically denied and you will lose the opportunity to use those credits if you attempt to log on after that 12 months period.

Payment Terms and Conditions for face to face courses.

Face to face courses may be accessed by booking either Online via the website www.noblekhan.com or direct through the office of Noble Khan.

Payment may be made at the same time through Noble Khan’s Online secure payment facility.

If you do not pay at the same time as booking, once Noble Khan has received a verbal booking you will be sent a booking form. Once that is completed and signed by you and received by Noble Khan the contract is complete and an invoice for payment is sent to you. That invoice is non cancellable and must be paid.

Payment of the invoice may be made by the Online secure payment facility or cheque or a direct BACS payment.

If paying by cheque please ensure that the invoice number and account number and course dates are written on the reverse of the cheque. All bookings forms and cheques should be made payable to Noble Khan Limited and sent to:

The relevant fee must be paid in full prior to attendance. Noble Khan Ltd shall not be under any liability to the client to provide a place on the face to face course until such time as full payment has been received by Noble Khan.

The face to face training must be booked within 6 months of purchase. The face to face training must be completed within 12 months of purchase. In other words all face to face courses must be completed within 12 months of purchase and there is no refund for courses paid for but not completed after the 12 month period.

CORPORATE COMPANY BOOKINGS

Travel Fee & Additional Charges

Travel charges are invoiced separately and are strictly payable within 7 working days from date of invoice. If no car parking facilities are available, Noble Khan will charge any fees accumulated to the customer. Travel is calculated at 65 pence per mile unless agreed otherwise. Additional charges include car parking facilities, zone charges, taxis, any other travel fares, overnight accommodation and any other expenses that may accumulate.

Working Lunch

Where training days or coaching or consultancy services are delivered on the clients’ premises, and lunch is not provided, any expenses accumulated by Noble Khan staff will be charged to the client as an additional charge subject to a maximum daily charge of £25.00.

Cancellation Policy – Online credits

Noble Khan has a strict no refund policy in respect of Online credits. Once a booking has been made and payment received and a course credit (s) allocated by Noble Khan no refund will be paid under any circumstances. Noble Khan reserves the right to refuse any request for cancellation of an Online credit(s). You are fully liable for any invoice allocated for Online credits.

Cancellation Policy – face to face course

 Noble Khan has a strict no refund policy in respect of the face to face course. Once a booking has been made and payment received and a course seat allocated by Noble Khan no refund will be paid under any circumstances. Noble Khan will agree to a request for a change to a different date for a face to face course subject to:

    2.1 An alternative date being available and
    2.2 The request is made by you no later than 14 days before the course that you have booked.
    3.3 A request to change dates made within 14 days of the course will be denied and no refund will be paid.

ASSESSMENT CRITERIA

Online Courses Assessment Criteria

Delegates will be assessed using a multiple-choice, randomly generated, PC based examination focussing on the stated learning outcomes. The pass mark is 70% to enable you to complete the course successfully.

Training Day Assessment Criteria (Face to Face)

Delegates booked on to a training day course must ensure they arrive promptly, and at least 15 minutes prior to registration. as detailed on the respective ‘Training Day Outline.’ Failure to do so may mean that the delegate is unable to complete Paper 1 of the exam which will result in not being provided with a score. Failure to achieve the minimum scores as detailed in the terms & conditions will result in EDI accreditation not being granted.

The face to face courses are assessed using a variety of fun based activities using NLP techniques to ensure a positive change in behaviour is achieved, where required. In addition to this, a short answer question paper is also given as well as a short answer worksheet.

The Assessment is split into three parts:

Written exam – the exam is split into two parts, papers 1 & 2. These focus on the specific learning outcomes for that course and the information provided on the day.

    Delegates are expected to acquire an overall mark of 70% or over on paper 2 only.

Interactive Activities - These fun based activities are assessed through a combination of the delegates responses in approaching new activities outside their own comfort zone. The tutor will take into account attitude, body language and linguistics used in attempting to complete the activities. It is at the discretion of the trainer to decide if activities have been attempted and completed. Although individuals must complete 7 out of 13 activities, no one is judged on how well they complete the activities, more that they were attempted in good faith and with an eagerness to learn.


Worksheet - Each delegate is required to illustrate how they can put what they have learnt into practice into everyday situations, as well as in relation to their own workplace, social events and customer service roles. At least 3 different examples are required.

Training Day Accreditation (Face to Face)

Once all papers have been marked, all delegates will be given marks on the two exam papers only. No marks are provided for the activities and worksheet. Please note that if the tutor does not feel that any individual or group has gained a sound understanding or achieved the learning outcomes set out for this course, demonstrated by behaviour, body language, attitudes, failing to achieve the pass mark for the exam or failed to attempt at least 7 out of the 13 activities, or any other circumstances that contribute to not fully enhancing their awareness on the subject, accreditation will not be achieved.

A certificate of attendance may be awarded instead.

Accreditation is solely at the discretion of the trainer.

Certificates

One-Day workshops are calculated per day and include the cost of any course material provided on the day by the tutor. One accredited certificate per delegate (subject to assessment criteria) is included in the cost of the course. If you achieve accreditation on a face to face course (subject to assessment criteria) you will be awarded with an accredited certificate. Where accreditation has not been achieved, Noble Khan is able to provide the delegates with “Certificates of Attendance”.

Duplicate Certificates

Noble Khan will provide, upon request, a duplicate certificate of Accreditation or Attendance upon payment of fee of £45.00 each excluding VAT.

Procedure in the event there is a Complaint regarding the marks obtained on a Face to Face course.

If a complaint is raised in relation to the level of the mark for the exam or failing the exam on the face to face course then at the request of the delegate an independent Audit will be arranged to review the papers upon payment of the fee of £65.00 from the delegate/client for this service. If a mistake is discovered a letter of apology will be sent to the candidate concerned and the company or organisation and a full refund of the £65.00 charge.

Complaint about not obtaining an Accredited Certificate

If a complaint is made by a delegate or organisation in relation to the course tutor refusing to agree accreditation then at the request of the delegate and upon payment by the delegate of a fee of £250, Noble Khan will appoint a third party to carry out a review. Results, testimonials, emails and feedback forms will all be taken into account. All complaints and grievances are taken extremely serious by Noble Khan. We ensure the best quality service possible by all our staff. All issues raised will be noted and dealt with. Action will be taken where required. Responses will be made in writing to all parties concerned. A charge for the above requests are made as our staff are highly trained and all papers are marked and remarked twice, before any results are published. Our trainers are Licensed Master Practitioners in NLP (Neuro Lingusitc Programming) and so accreditation is subject to observations they carry out throughout the day.

Grievance Policy & Complaints Procedure

All grievances and complaints should be made as soon as possible to Ms Sadi Khan Managing Director, Noble Khan Limited The Cultural Centre registered office 277 Curzon Street Long Eaton Nottinghamshire NG10 4FJ. Ms Khan will address the issues raised and will try to resolve things informally. However if you remain dissatisfied then Ms Khan will appoint a third party to review the issues raised and if appropriate appoint a mediator to try to resolve the issues.

Noble Khan does not admit liability for your future actions.

Noble Khan Ltd acknowledges that people are individuals and may not fit neatly into certain categories; follow the same customs or behaviours. It is important not to assume that all groups of people will hold the same beliefs and practices listed in the online learning hub, booklet and one day workshops. Noble Khan Ltd will not be held responsible for any cultural encounter that you may experience after attending any of our courses both online and one day workshops. How you use your newly acquired skills is entirely at your own discretion and you must take full personal responsibility of your actions for such encounters. We, Noble Khan Ltd will not be held responsible for any issues that arise subsequently from the use of our online course and attendance on our one-day workshops.

Force Majeure

We shall not be in default of this Agreement by reason of its delay in the performance of or failure to perform, in whole or in part, any of its obligations hereunder, if such delay or failure results from occurrences beyond its reasonable control and without its fault or negligence.
