Noble Khan’s Terms & conditions apply to the use of all our websites, including all our services; consultancy, one day workshops, online courses an our booklets, and any other materials handed out by Noble Khan Ltd. This is the noblekhan.com website. Your use of this website is subject to the following terms and conditions, which you are deemed to accept each time you use the website. "you" means the person firm, company or organisation browsing and/or using the Noble Khan website, and "your" shall be construed accordingly. Changes to Terms and Conditions and Invalidity These website terms and conditions may be changed by us at any time. You will be deemed to accept the terms and conditions (as amended) when you next use this site following any amendment. If any provision of these terms and conditions is held to be invalid by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining provisions, which shall remain in full force and effect.

Interruptions and Omissions in Service

Whilst Noble Khan Ltd will try to ensure that the standard of this website remains high and to maintain the continuity of it, the internet is not an inherently stable medium, and errors, omissions, interruptions of service and delays may occur at any time. Noble Khan Ltd does not accept any liability arising from any such errors, omissions, interruptions or delays. We may vary the specification of this site from time to time without notice.

You may only use this site for lawful purposes. You must not under any circumstances seek to undermine the security of the Site or any information submitted to or available through it. Information Submitted by You

Noble Khan Ltd use third parties to formally accredit your test results. We may collect and aggregate data from the information supplied by you to help us to understand our users as a group so that we can provide you with a better service. We may also share aggregate information with selected third parties, without disclosing individual names or identifying information. We will process any data which you provide in completing the online registration or application forms and any further forms, assessments or personal details which you complete or provide to us when using this site in accordance with UK data protection legislation.

Security and Passwords

In order to register with this site and to sign in when you visit the site, you will need to use a user name and password. You are solely responsible for the security and proper use of your password, which should be kept confidential at all times and not disclosed to any other person. You must notify us immediately if you believe that your password is known to someone else or if it may be used in an unauthorised way. We accept no liability for any unauthorised or improper use or disclosure of any password.

Termination

Noble Khan Ltd may terminate your registration and/or deny you access to the site or any part of it (including any services, goods or information available on or through the site) at any time in our absolute discretion and without any explanation or notification.

Liability

Noble Khan Ltd accept no liability for any loss (whether direct or indirect, for loss of business, revenue or profits, wasted expenditure, corruption or destruction of data or for any other indirect or consequential loss whatsoever) arising from your use of the site and we hereby exclude any such liability, whether in contract, tort (including for negligence) or otherwise. We hereby exclude all representations, warranties and conditions relating to this website and your use of it to the maximum extent permitted by law. You agree to indemnify us and keep us indemnified against all costs, expenses, claims, losses, liabilities or proceedings arising from use or misuse by you of this site. You must notify us immediately if anyone makes or threatens to make any claim against you relating to your use of this site.

Choice of Law and Jurisdiction

The use of this website and any agreements entered into through this website are to be governed by and construed in accordance with English law. The courts of England are to have exclusive jurisdiction to settle any dispute arising out of or in connection with the use of this website or any agreement made through this website.

Force Majeure

We shall not be in default of this Agreement by reason of its delay in the performance of or failure to perform, in whole or in part, any of its obligations hereunder, if such delay or failure results from occurrences beyond its reasonable control and without its fault or negligence.

Fees and Charges

You are responsible for full payment within the specified time of all fees. Noble Khan Ltd only distributes invoices once a verbal agreement of services and credits has been confirmed by both parties. Therefore you are responsible for full payment of all invoices agreed and sent by Noble Khan Ltd.

Payment Terms

The agreed fee must be paid in full prior to the course or credit allocation, either at the time of booking or on receipt of invoice. Noble Khan Ltd shall not be under any liability to the client until such time as full payments in accordance with the booking invoice has been received by the said Noble Khan Ltd. All cheque payments need to ensure that Invoice number/Account Number/course details and course dates are written on the reverse of the cheque. Cheques should be payable to NOBLE KHAN LTD and sent to the address below stating “Booking Department”. Those paying by BACS, need to ensure that they contact the office to obtain the relevant information.

Travel Fee & Additional Charges

Travel charges are invoiced separately and are strictly payable within 7 working days from date of invoice. If no car parking facilities are available, Noble Khan will charge any fees accumulated to the customer. Travel is calculated at 65 pence per mile unless agreed otherwise. Additional charges include car parking facilities, zone charges, taxis, any other travel fares, overnight accommodation and any other expenses that may accumulate.

Working Lunch

Where training days or consultancy are delivered on the clients’ premises, and lunch is not provided, any expenses accumulated by Noble Khan staff will be charged to the client as an additional charge.

Certificate Charges

One-Day workshops are calculated per day and include the cost of any course material provided on the day by the tutor. One set of accredited certificates (subject to assessment criteria) are included in the cost of the course, (supplied by EDI).

Certificates Of Attendance

Where accreditation has not been achieved, Noble Khan Ltd is able to provide the delegates with “Certificates Of Attendance”, an additional charge of £11.50 will be payable in addition to any agreed invoices.

Duplicate Certificates

All duplicate certificates, Accredited or In-House, will be charged at an additional fee of £25.00 each Excluding VAT.

Online Courses

Your use of the Noble Khan Ltd online course is subjected to the above standard terms and conditions; as well as:

Assessment Criteria (Online Courses)

Delegates will be assessed using a multiple-choice, randomly generated, PC based examination focussing on the above learning outcomes. The pass mark, to successfully complete the course, is 70%.

Noble Khan Course

Content Free From Liability Noble Khan Ltd acknowledges that people are individuals and may not fit neatly into certain categories; follow the same customs or behaviours. It is important not to assume that all groups of people will hold the same beliefs and practices listed in the online learning hub, booklet and one day workshops. Noble Khan Ltd will not be held responsible for any cultural encounter that you may experience after attending any of our courses both online and one day workshops. How you use your newly acquired skills is entirely at your own discretion and you must take full personal responsibility of your actions for such encounters. We, Noble Khan Ltd will not be held responsible for any issues that arise subsequently from the use of our online course and attendance on our one-day workshops.

Payment Policy (Online Courses)

All online credits require full payment in advance. These can be made online through our secure payment facility or by invoice. You are responsible for payment of any invoice sent by Noble Khan Ltd for online credits. No credits will be added to your account until all necessary invoices are paid in full.


Cancellation Policy (Online Courses)

No Refunds are given for online credits. Once payment has been received and a course credit has been allocated Noble Khan Ltd will reserve the right to refuse any request to cancellation. You are fully liable for any invoice that has been allocated for online credits.

Training Days (Face to Face Courses)/Consultancy/Presentations

In addition to the standard terms and conditions, training days, consultancy and presentations are subject to the following:

Training Day (Face to Face Courses)

Delegates booked on to a training day course must ensure they arrive promptly, as detailed on the respective ‘Training Day Outline.’ All delegates are requested to arrive at the venue at least 15minutes prior to registration. Failure to do so may result in missed information or practical demonstrations which could have a detrimental effect on ones final test and practical score. Failure to achieve the minimum scores as detailed in the terms & conditions will result in EDI accreditation not being granted.

Diversity & Equality Policy

Noble Khan is committed to a policy of equality of opportunity for its employees, customers and attendees/learners. The policy aims to ensure that no employee, customer, client/attendee/learner is treated less fairly by Noble Khan on the grounds of race, disability, nationality, ethnic or national origin, creed, sex, marital status, culture, religion or religious belief, age or sexual orientation. For those who require aid, translator or any other form of help on our face to face courses, please ensure that you contact the office to ensure special needs are met. Failure to notify Noble khan of any special requirements may result in no special provisions being met.

Training Day Assessment (Face to Face)

All Noble Khan’s courses are assessed using a variety of fun based activities using NLP techniques to ensure a positive change in behaviour is achieved, were required. In addition to this, a short answer multiple choice question paper is also given as well as a short answer worksheet.

Training Day Assessment Criteria (Face to Face)

The Assessment is split into three parts, Exam, Activities, and Worksheet

Exam

Delegates are assessed using a multiple-choice, question paper focusing on the specific learning outcomes for that course. Delegates are expected to obtain a mark of 70% or over on paper1.

Activities

The fun based activities are assessed through a combination of the delegates responses in approaching new activities outside their own comfort zone, the tutor will take into account, attitude, body language, and linguistics used in attempting to complete the activities. The ability to attempt the activity will also be noted. Even though 7 out of 10 activities, are required to be completed, it is at the discretion of the trainer to decide if activities have been approached and completed. Individuals are NOT Judged on how well they complete the activities.

Worksheet

Each delegate is required to illustrate how they can put what they have learnt into practice into everyday situations, as well as in relation to their own workplace, social events and customer service roles. At least 3 different examples are required.

Training Day Accreditation (Face to Face)

Please note that if the tutor does not feel that any individual or group has gained a sound understanding or achieved the learning outcomes set out for this course, due to behaviour, body language, attitudes, or any other circumstances that they feel contribute to not fully enhancing their awareness on the subject, accreditation will not be agreed. A certificate of attendance may be given instead. Accreditation is solely at the discretion of the trainer.

Training Day Result (Face to Face)

Once all papers have been verified, all delegates will be given marks on papers 1 and 2 only. No marks are provided for activities and worksheet.

Payment Policy (Face to Face Courses)

Full payment in advance is required to secure registration date(s) requested. When signing the registration form the applicant is signing on behalf of all those attending the programme, and that they have read, are aware and agree to the company’s Terms. They also state (Where training is delivered in-house) that the premises where the training will take place comply with the Health & Safety at Work Act 1974. Failure to comply with the Health & Safety may require rejection of the registration or may require alternative accommodation to be sought. This cost will be expensed to the client. You are responsible for payment of any Invoices sent by Noble Khan Ltd once registration form is signed.

Cancellation Policy

(Face to Face Courses/Presentations/Consultancy) No Refunds are given once a booking has been made and agreed. Cancellations must be received at least one month prior to the original training date in writing and addressed to: The Cultural Centre The Managing Director Noble Khan Ltd 277 Curzon Street Long Eaton, Nottingham NG10 4fJ. If you wish to change your original booking date, you must do so in writing. The Request will be effective from the date of receipt by Noble Khan Ltd. We cannot guarantee that any requests for amendments will be met. However, if you wish to make an alteration after it has been accepted we will try and accommodate your requirement, subject to availability. An alteration fee of £65.00 will be charged. Where Noble Khan Ltd staff request a training course/presentation/consultancy day to be cancelled an alternative date will be offered to the client, otherwise a full refund will be offered, where payment has already been taken.

Grievance Policy & Complaints Procedure

All grievances and complaints should be made as soon as possible to the Board Of Directors of Noble Khan Ltd, in writing; To Mrs Louise Trevatt.

Complaint in Marks Obtained

If a complaint is made in relation to the marks, or a candidate fails, a remark will be made at a cost of £165.00 to the delegate/client, an outside Audit will be arranged to mark the papers. If a mistake is acknowledge a letter of apology is made to the candidate concerned and the company or organisation.

Complaint in Not Obtaining an Accredited Certificate

If a complaint is made by a delegate or organisation in relation to the course tutor refusing to agree accreditation an interview with the tutor in dispute will be carried out by Noble Khan Ltd external accreditation team. Results, testimonials, emails and feedback forms will all be taken into account. A charge of £1250.00 will be requested or invoiced to the delegate/client. No interview will take place until payment has been paid in full. All complaints and grievances are taken extremely serious by Noble Khan. We ensure the best quality service possible by all our staff. All issues raised will be noted and dealt with. Action will be taken where required. Responses will be made in writing to all parties concerned. A charge for the above requests are made as our staff are highly trained and all papers are marked and remarked twice, before any results are finalized. Our trainers are Licensed Master Practitioners in NLP (Neuro Lingusitc Programming) and so accreditation is subject to observations they carry out throughout the day.
